'Thoughts on Life and Religion' is a compilation of essays by F. Max Müller, a renowned scholar who lived with the belief that everything in life happens for our own good, even if we cannot always understand it. This collection includes passages from his published works, as well as his private letters and unfinished writings. Müller's unwavering trust in a higher power gave him strength through difficult times, including the loss of loved ones and his own illness. The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty measurement; (...) and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. The chapter concludes with some implications of our research for a theory of need-based justice. (shrink)

Jonathan Livengood and Justin Sytsma have published a series of studies on “Actual Causation and Compositionality,” in which they investigate causal attributions of laypeople. We use one of their vignettes to follow up on their research. Our findings cast doubt on their conclusion that ordinary causal attributions tend to violate the compositionality constraint if one looks at cases in which someone is responsible for an effect by way of an intermediary that does not share in the responsibility.

Needs play a key role in many fields of social sciences and humanities, ranging from normative theories of distributive justice to conceptions of the welfare state. Over time, different conceptions of what counts as a need (i. e., what is considered a normatively relevant need) have been proposed. Many of them include (in one way or the other) needs for survival, decency, belonging, and autonomy. Little work has been done on how these kinds of needs are evaluated in terms of (...) their significance for distributive justice. To begin closing this gap, we investigate the role of the four aforementioned kinds of needs for impartial observers. We do so in two empirical studies. The first study asks participants to evaluate the importance of each of the four kinds of needs separately. We find that different levels of importance are attributed to the kinds of needs, which places them in a hierarchy. The second study asks participants to make distributive decisions. Results further support the hierarchy found in the first study and, additionally, reveal that participants tend to make coherent allocation decisions. (shrink)

The role that need plays in dealing with problems of distributive justice is examined in a series of vignette studies. Among other things, it becomes clear that impartial observers make gradual assessments of justice that depend on the extent to which the observed individuals are endowed with a good. If it is known how high their need for that good is, the assessments are made relative to this reference point. In addition, impartial decision-makers make hypothetical distribution decisions that take into (...) account need, productivity, and accountability. The need of individuals is partially compensated even if they have contributed less to the available amount than they themselves require. However, the willingness to do so decreases if they are accountable for needing more than others or for having contributed less than others. Lastly, both impartial observers and impartial decision-makers distinguish between different types of needs, the fulfillment of which is given different levels of importance. (shrink)

This paper reads Blumenberg’s posthumously published study Die nackte Wahrheit as a book left unfinished because a major, if not central, chapter was still pending: a chapter on Husserl’s metaphor of a dress of ideas (“Ideenkleid”) that veils the lifeworld. Arguing that Blumenberg aimed at a phenomenological foundation for his metaphorology based on his critique and inversion of the Husserlian concept of lifeworld, the article reveals resulting tensions between Blumenberg’s late and early theoretical approaches to a theory of metaphor that (...) sought, but did not find, a solution in his own theory of lifeworld, which remained unfinished as well. Due to the increasingly heterogeneous trajectories of aging, gerontology requires theoretical models and empirical methods that can meaningfully, reliably, and precisely describe, explain, and predict causes and effects within the aging process, considering particular contexts and situations. Human behavior occurs in contexts; nevertheless, situational changes are often neglected in context-based behavior research. This article follows the tradition of environmental gerontology research based on Lawton’s Person-Environment-Interaction model and the theoretical developments of recent years. The authors discuss that, despite an explicit time (...) component, current P-E models could be strengthened by focusing on detecting P-E interactions in various everyday situations. Enhancing Lawton’s original formula via a situationally based component not only changes the theoretical perspectives on the interplay between person and environment but also demands new data collection approaches in empirical environmental research. Those approaches are discussed through the example of collecting mobile data with smartphones. Future research should include the situational dimension to investigate the complex nature of person environment interactions. (shrink)

Livengood and Sytsma (2020) challenge the Compositionality Constraint of Actual Causation (CCAC), according to which each intermediary of a causal chain is an effect of its predecessor and a cause of its successor link. In several studies, they find support for their hypothesis that the CCAC is not in accordance with ordinary causal attributions of laypeople. We argue that there are three interrelated problems in their studies’ design that we call the Causality-Responsibility Confusion (CRC), the Intermediary-Ontology Confusion (IOC), and the (...) Cause-End Questioning (CEQ). Avoiding the CRC, the IOC, and the CEQ leads to strong empirical support for the CCAC. (shrink)

The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

In attempts to compare different distributions with regards to need, so-called “measures of need-based distributive justice” have emerged in recent years. Each of the proposed measures relies on a single dimension of need that is taken into account. This is shown to be problematic since humans experience different kinds of need that appear to be incommensurable. A strategy to deal with this problem is introduced by using multidimensional measures.

Spiel und Arbeit gelten oft als Gegensätze: Das Spiel als freie Betätigung menschlicher Vermögen, die Arbeit als deren Subordination unter einen äußeren Zweck. Die Festlegung des Spiels auf konsequenzlose Wiederholbarkeit hat ihm den Ruf des Unernsten eingetragen, während das Abzwecken der Arbeit auf die Nützlichkeit ihres Resultats im Bund mit der Sorge ums Dasein steht. Auf einen zweiten Blick scheint dieser Gegensatz jedoch, gerade in den hochentwickeltsten Ausprägungen beider Tätigkeitsformen, zu verschwinden. So kann eine hochgradige Rationalisierung von Spielpraktiken in Arbeit (...) umschlagen, wie etwa im Leistungssport, oder ein komplexer Arbeitsvorgang selbstzweckhafte Momente und Eigendynamiken gewinnen, die ihm Spielcharakter verleihen. Auch andere technologische Entwicklungen geben Anlass dazu, das Verhältnis von Spiel und Arbeit noch einmal grundsätzlich zu bedenken, etwa im Hinblick auf: adaptive Systeme in der Robotik, serious games, Kreativitätstechniken in Unternehmenskulturen, wissenschaftliche Experimentalanordnungen, Online-Rollenspiele oder die Kommodifizierung nicht-zweckrationaler Lebensvollzüge, die traditionell vom Begriff produktiver Arbeit ausgeschlossen waren – einschließlich der Spielräume, die durch neue Umwelt- und Biotechniken erschlossen werden. We examine the role of need satisfaction in non-comparative justice ratings about endowments with goods. As normative approaches, we discuss utilitarianism, prioritarianism, and sufficientarianism. Using a vignette experiment, we show that a need context increases the prevalence of prioritarianistic and sufficientarianistic justice ratings, which leads to an ethically problematic sigmoid shape of the justice evaluation function.

We report the results of a vignette study with an online sample of the German adult population in which we analyze the interplay between need, equity, and accountability in third-party distribution decisions. We asked participants to divide firewood between two hypothetical persons who either differ in their need for heat or in their productivity in terms of their ability to chop wood. The study systematically varies the persons’ accountability for their neediness as well as for their productivity. We find that (...) participants distribute significantly fewer logs of wood to persons who are held accountable for their disadvantage. Independently of being held accountable or not, the needier person is partially compensated with a share of logs that exceeds her contribution, while the person who contributes less is given a share of logs smaller than her need share. Moreover, there is a domain effect in terms of participants being more sensitive to lower contributions than to greater need. (shrink)

Dabei sind historisch verschiedenste Positionen verhandelt worden. Es soll nicht versucht werden, eine Antwort auf die Frage nach der Möglichkeit zu liefern; vielmehr sollen methodische Überlegungen zur Klärung der Frage in den Fokus gerückt werden. Es wird gezeigt, dass die eigentliche Frage präzisierungsbedürftig ist. Exemplarisch wird ein ausgewählter Präzisierungsversuch aus dem zeitgenössischen Diskurs kritisch beleuchtet und ihm wird ein (...) Überwindet Technik das unheimlich Unbeherrschbare? Oder wird sie uns selbst unheimlich? Zwei scheinbar widersprüchliche Narrative prägen die Geschichte und auch die Theorie der Technik: Das Narrativ der Entzauberung beschreibt, wie eine als fremd und gefährlich erfahrene Natur durch Verwissenschaftlichung und Technisierung gezähmt wurde. Das Narrativ der Verzauberung schildert, wie uns Artefakte und technologische Möglichkeiten unheimlich werden, insbesondere wenn sie sich zu verselbständigen scheinen oder mit „autonomem“ Eigensinn gegenübertreten. In den heutigen Debatten um selbstlernende, ubiquitär verteilte, im Assistenzmodus unsichtbare, dabei opake (...) Techniken schwingt das unheimliche Moment einer „Verselbständigung“ von Technik mit – und trägt im Anschluss an die Mechanisierungs- und Automatisierungsdiskurse des 20. Jahrhunderts zur „Dämonisierung“ der Technik bei. Technik macht Welt einerseits vertraut und nachvollziehbar: Paradigmatisch wird dies in der Idee, dass etwas dann verstanden wird, wenn es technisch rekonstruiert werden kann. Andererseits wird die technische Reproduktion von Welt – oder deren radikale Umgestaltung zu einer entfremdeten – als etwas Verstörendes erlebt. Spätestens, wenn Artefakte zu tun scheinen, „was sie wollen“ oder technische Großsysteme die Lebenswelt nach ihren „Eigenlogiken“ prägen, ist eine schon von Freud benannte Grenze erreicht, an der wir verunsichert werden, ob wir überhaupt noch in der modernen Welt leben. Verteilungsgerechtigkeit befasst sich mit der Verteilung von Gütern innerhalb einer Gruppe, wobei verschiedene Verteilungsprinzipien und -ergebnisse als mögliche Ideale einer solchen Verteilung verhandelt werden. Diese normativen Ansätze sind oft rein verbal formuliert, wodurch ihre Anwendung auf unterschiedliche konkrete Verteilungssituationen, die hinsichtlich ihrer Gerechtigkeit beurteilt werden sollen, häufig schwer fällt. Eine Möglichkeit, fein abgestufte Gerechtigkeitsbeurteilungen verschiedener Verteilungen präzise erfassen zu können, besteht in der formalen Modellierung solcher Ideale durch Maße oder Indizes. Die Auswahl eines geeigneten Maßes, das ein gewisses Ideal abbilden (...) soll, muss ihrerseits eine Fundierung erfahren, was durch die Forderung von begründeten Axiomen erreicht werden kann, denen ein Maß genügen soll. In der vorliegenden Arbeit werden solche Axiome für Maße der Verteilungsgerechtigkeit am Beispiel von Bedarfsgerechtigkeit eingeführt. Ferner werden exemplarische Maße der Bedarfsgerechtigkeit vorgestellt. Damit wird für die Beurteilung und Modellierung von Maßen der Verteilungsgerechtigkeit eine erste diskutable Grundlage gelegt. Distributive justice deals with allocations of goods and bads within a group. Different principles and results of distributions are seen as possible ideals. Often those normative approaches are solely framed verbally, which complicates the application to different concrete distribution situations that are supposed to be evaluated in regard to justice. One possibility in order to frame this precisely and to allow for a fine-grained evaluation of justice lies in formal modelling of these ideals by metrics. Choosing a metric that is (...) supposed to map a certain ideal has to be justified. Such justification might be given by demanding specific substantiated axioms, which have to be met by a metric. This paper introduces such axioms for metrics of distributive justice shown by the example of needs-based justice. Furthermore, some exemplary metrics of needs-based justice and a three dimensional method for visualisation of non-comparative justice axioms or evaluations are presented. Therewith, a base worth discussing for the evaluation and modelling of metrics of distributive justice is given. (shrink)

The discourse on economic integration with authoritarian regimes has evolved as a key topic throughout the different disciplines of social sciences. Are sanctions and boycotts effective methods to incentivize human rights improvements? To analyze this question, we focus on the situation in China’s Xinjiang province from 2010 to 2019. In this paper, we discuss the relevance of human rights as an ethical norm within business ethics and international law. We evaluate the ongoing processes in Xinjiang from this perspective and scrutinize (...) the interests of major players in the region, including the Central Government of the People’s Republic of China, Xinjiang’s local government, and enterprises involved in the region. Following this, we discuss which economic measures will improve the human rights situation and how these measures contribute to an improvement of the situation. (shrink)

Two questions often shape our view of the world. On the one hand, we ask what there is, on the other hand, we ask what there ought to be. Empirical research and normative theory, the methodological traditions concerned with these questions, entered a difficult relationship, from at least as early as around the time of the advent of modern sciences. To this day, there remains a strong separation between the two domains, with both tending to neglect discourses and results from (...) the other. Contrary to a verdict of strict segregation between »is« and »ought«, there are, nowadays, various attempts to integrate both theoretical approaches. This calls for a newly intensified discourse on the relation between empirical research and normative theory. In this volume, scholars from different disciplines – including psychology, sociology, economics, and philosophy – discuss possible desired or undesired influences on, and limits of, the integration of these two approaches. We present a vignette study conducted with a quota sample of the German population (n = 400). Subjects had to redistribute a good between two hypothetical persons who contributed equally to the available amount but differed in quantity needed and the reason for their neediness. On a within-subjects level, we tested for the effects of need, accountability, and resource availability on their third-party distribution decisions. Between subjects, we further varied the kinds of needs: The persons either needed the good as (...) a means to survive, to live a decent life, to participate in society, or to be autonomous. Despite equal productivity, the mean share allocated to the needier person was significantly higher than an equal share. However, this share turned out significantly smaller when the needier person was accountable for needing more than the other. Nonetheless, even if accountable, the needier person still got a share larger than their contribution would suggest. When there was a surplus of resources, the needier person got an even higher share than when resources were scarce. (shrink)

The thematic focus of this yearbook is concerned with the various relations of „art“ and „technology“. It seeks to interrogate and reflect their conceptual filiations, their complementarities and mutual stimulations, and contrasts and tensions. The very notion of the „work“ challenges us to explode or triangulate the dichotomy of art and technology. Das Nichtwissen ist in aller Munde. Von Nichtwissenskulturen in der zweiten oder reflexiven Moderne ist die Rede, von Agnotologie als neuem Forschungszweig, von wicked problems und ihren clumsy solutions. Wo Nichtwissen sich durch Komplexitäts­steigerung unwiderruflich im zu Wissenden einnistet, fordert es als Grenze, Schranke und Kehrseite des Wissens die sogenannte Wissensgesellschaft heraus. Vor allem Risiko­poten­ziale und Gefahren kommen hier in den Blick, von denen wir gerade genug wissen, um Wissensansprüche zu formulieren, die sich womöglich nie einlösen lassen. Das klassisch erkenntnistheoretische (...) Problem: „Was können wir wissen?“ steht heute in einem Spannungsverhältnis zu der wissenspolitischen Frage: „Was müssen wir wissen?“ Was wir wissen müssen, ist einerseits so viel wie nötig, wenn es um Fragen von Sicherheit und Gesundheit geht – andererseits aber so wenig wie möglich, wenn es in Alltag, Wirtschaft oder Wissen­schaft darauf ankommt, Wissen an technische Systeme oder Expertenkulturen zu delegieren. Bezeichnet politisch handlungsorientiertes und wissenschaftliches Nichtwissen zunächst ein Defizit, ist technisches Nichtwissen gleichermaßen erstrebenswert und problematisch. Einige, die Technik für angewandtes Wissen halten, mögen darin eine contradictio in adjecto sehen, manche sich um eine dem technischen Nichtwissen geschuldeten Technik­feindlichkeit sorgen, andere daraus die nötige Demut gegen verstiegene Allmachts­fantasien beziehen, während ihre Gegenspieler von Maschinen träumen, die über den Horizont intellektueller Nachvollziehbarkeit immer weiter hinauseilen. Unter dem Dach der Philosophie gingen empirische Forschung und normative Theorie lange Zeit Hand in Hand, bis sie spätestens um die Zeit der Emanzipation der Einzelwissenschaften in eine schwierige, nicht immer eindeutig bestimmbare Beziehung zueinander traten; dieses unterbestimmte Verhältnis tritt uns vor dem Hintergrund aktueller Debatten wieder entgegen. Das zeigt sich zum Beispiel auch bei Fragen der Ethik: In den letzten Jahrzehnten zeigten verschiedene wissenschaftliche Disziplinen verstärktes Interesse an empirischen Bemühungen um ein deskriptives Verständnis von Moral. Hier gibt es nach (...) wie vor eine starke Trennung zwischen den Bereichen der normativen Theorie einerseits und der empirischen Forschung andererseits, wobei in beiden Bereichen dazu tendiert wird, die jeweils anderen Diskurse zu vernachlässigen, wobei Unklarheit über die Möglichkeiten und Grenzen einer fruchtbaren Integration herrscht. Auf der anderen Seite gibt es jüngst auch verschiedene Versuche einer Integration beider Domänen. – Dies macht einen Diskurs über die Bestimmung des Verhältnisses von empirischer Forschung und normativer Theorie nötig, was in diesem Band aus verschiedenen historischen sowie systematischen Perspektiven geleistet wird.
